Terms of Service

These terms are a contract between you and Pour Global Ltd(trading as “Bene”), registered in England and Wales, company number 15531004, registered office 5 Canon Court, Institute Street, Bolton, England, BL1 1PZ. By creating an account or using the Bene app, you agree to them. If you don't agree, please don't use the app.
1. What Bene is
Bene is a health and fitness tracking app: you log workouts, nutrition, body weight, and habits, plan training, and optionally connect Apple Health — and Bene connects it all into one picture, including an AI coach that comments on your own logged data. Some features require an active subscription (section 5).
2. Not medical advice
Bene is a tracking and informational tool, not a medical device, and nothing in the app — including coach replies, nutrition estimates, statistics, and trends — is medical, dietary, or treatment advice.
- Always consult a qualified healthcare professional before starting a new exercise or nutrition programme, especially if you have a medical condition, are pregnant, or are taking medication.
- Stop exercising and seek medical attention if you feel pain, dizziness, or discomfort. You are responsible for training within your own limits.
- AI-generated content can be wrong. Coach replies are conversational guidance grounded in your logs, and meal-scan results are estimates that you should review and correct before logging. Do not rely on them for medical decisions, allergy safety, or precise dietary requirements.
- Bene is not intended to diagnose, treat, cure, or prevent any disease or condition, including eating disorders. If tracking food or weight negatively affects your wellbeing, please stop using those features and consider speaking to a professional.
3. Your account
- You must be at least 16 years old to use Bene.
- Keep your sign-in credentials secure; you are responsible for activity on your account.
- The information you provide must be accurate — the app's outputs are only as good as what you log.
- You can delete your account at any time in the app (Profile → Delete account); deletion is permanent.
4. Your content and data
Your logged data belongs to you. You grant us a limited licence to store, process, and transmit it solely to operate the service — syncing it to your account, computing your statistics, and (when you use the AI features) generating coach replies and nutrition estimates, as described in our Privacy Policy. We claim no other rights over it, and the licence ends when you delete your data or account.
5. Subscriptions and free trial
- Bene is offered as an auto-renewing subscription with an introductory free trial. The price, billing period, and trial length are shown clearly in the app before you subscribe.
- Payment is processed by Apple through your App Store account. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period (or before the trial ends, to avoid being charged).
- You can manage or cancel the subscription at any time in your App Store account settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its App Store terms — request them at reportaproblem.apple.com.
- We may change pricing for future billing periods; you will be notified in advance and can cancel before the change applies.
- AI features (coach and meal scan) are subject to fair-use limits to keep the service reliable for everyone.
6. Acceptable use
You agree not to:
- reverse engineer, copy, resell, or build a competing dataset from the app or its services;
- attempt to circumvent security, rate limits, device attestation, or subscription entitlements;
- use the AI features to generate content that is unlawful or harmful, or probe them to extract other users' data (they have no access to it);
- use the service in any way that violates applicable law.
We may suspend or terminate accounts that materially breach these terms, with notice where reasonably possible.
7. Intellectual property
The app, its design, branding, and software are owned by Pour Global Ltd or its licensors. We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by the App Store terms. Nutrition reference data is drawn from public sources including USDA FoodData Central (public domain), McCance & Widdowson's CoFID (© Crown copyright, OGL v3.0), and Open Food Facts (ODbL).
8. App Store
The app is distributed through Apple's App Store, and Apple's standard terms apply to the download itself. Apple has no obligation to provide support or maintenance for Bene and is not responsible for addressing claims relating to the app; those are our responsibility. You confirm you are not located in an embargoed country and are not on any restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Disclaimers and liability
The app is provided “as is” and “as available”. We work hard to keep it accurate and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that estimates (including AI-generated ones) will be accurate.
Nothing in these terms excludes or limits liability that cannot be excluded under the law of England and Wales — including liability for death or personal injury caused by our negligence, fraud, or your statutory consumer rights. Subject to that, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.
10. Changes to the service or terms
We are actively building Bene and may add, change, or remove features. If we make material changes to these terms, we will update this page and notify you in the app before they take effect; continuing to use Bene after that constitutes acceptance. If you don't accept a change, stop using the app and cancel your subscription.
11. Governing law and contact
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — though if you live elsewhere in the UK or in the EU, you keep any mandatory consumer protections and court rights of your home country.
